Terms
GrowthEko services are offered exclusively to entrepreneurs purchasing for their business. They are not offered to consumers. By ordering, you confirm that you act in the course of your trade, business, craft, or profession and are authorized to bind the named business.
1. Scope
These Terms apply to paid GrowthEko services ordered through growtheko.com, Stripe Checkout, or an order confirmation that incorporates these Terms. Conflicting customer terms apply only if accepted by Robin Ekren in writing.
GrowthEko serves business customers internationally. Orders from outside Austria require prior manual review and written approval, including verification of business status and the applicable tax treatment, before they can be accepted.
2. Services and prices
| Service | Price | Billing |
|---|---|---|
| GrowthEko Operator Membership Ongoing access to the marketing-focused AI operator resources, guidance, and features described on the order page at the time of purchase. |
$97 USD/month — net, plus applicable taxes | Recurring monthly until cancelled before the next billing date. |
| GrowthEko AI Operator Audit A focused remote B2B review of marketing, funnel, and related digital operator workflows, with a prioritized implementation roadmap as described on the order page. |
$1,997 USD one-time — net, plus applicable taxes | One-time charge. |
All prices are stated in US dollars and exclude applicable taxes. Austrian domestic B2B orders are ordinarily subject to 20% Austrian VAT. Cross-border treatment depends on the customer's verified business status, location, tax identification, and the legally applicable place-of-supply rules. The reviewed checkout or written order confirmation controls the final tax treatment and total.
3. Order and contract formation
- The offer page is an invitation to place an order. You enter accurate business and billing information, accept these Terms and the Privacy Policy, and continue to secure Stripe Checkout.
- A binding contract is formed when payment succeeds and the order is accepted through the confirmation page or confirmation email.
- We may reject or refund an order if the business status cannot be verified, information is inaccurate, the order falls outside the launch scope, or legal or payment checks fail.
4. Payment, recurring billing, and electronic invoices
- Payments and recurring card charges are processed by Stripe. Stripe's applicable terms and privacy information also apply to its processing.
- For the Membership, you authorize the monthly charge shown at checkout until cancellation. Failed payments may be retried and access may be paused while payment remains outstanding.
- Invoices, credit notes, payment notices, and related contract communications are issued electronically to the billing email supplied at checkout. You consent to receiving and retaining these documents electronically and must keep the billing email current.
- You can access available invoices and payment controls through the secure Stripe customer portal link or request assistance at info@growtheko.com.
5. Membership term and cancellation
The Membership begins when the first payment succeeds and runs for consecutive one-month billing periods. You may cancel through the secure customer portal or by emailing us before the next renewal. Cancellation stops future renewals and takes effect at the end of the paid period. Amounts already charged for a started billing period are not refunded or prorated unless required by mandatory law or expressly agreed in writing.
6. One-time Audit scheduling and delivery
Audit timing, requested information, meeting format, and deliverables are stated on the order page, onboarding flow, or written scheduling confirmation. You must provide complete and timely access to the information reasonably needed for delivery. Delays caused by missing customer input extend delivery dates accordingly. If cancellation or rescheduling is necessary, contact us promptly; fees for work already performed remain due.
7. Customer responsibilities
- Provide accurate business, tax, billing, and contact details and keep them current.
- Ensure that submitted materials, accounts, data, and instructions may lawfully be used for the service.
- Review recommendations before implementation and remain responsible for business decisions, approvals, published content, and system access.
- Use the services lawfully and do not share protected member access outside the purchasing business.
8. Marketing-related service boundary
GrowthEko provides marketing, advertising, funnel, digital product presentation, and related AI-enabled operator implementation support. The services do not constitute legal, tax, accounting, regulated financial, investment, medical, or licensed professional advice. They also do not replace advice from a qualified professional. No revenue, profit, savings, ranking, or other business result is guaranteed.
9. Intellectual property and permitted use
GrowthEko materials, templates, frameworks, text, designs, and training content remain owned by Robin Ekren or the relevant licensor. After full payment, the purchasing business receives a non-exclusive, non-transferable right to use delivered materials internally for its own business. Resale, public redistribution, sublicensing, or creation of a competing content library is not permitted without written consent. Customer-owned materials remain the customer's property.
10. Confidentiality
Each party will use non-public business information received from the other only for contract performance and will protect it with reasonable care. This does not apply to information that is public, independently developed, lawfully received from another source, or required to be disclosed by law.
11. Availability and third-party services
Digital services may rely on third parties such as Stripe, Vercel, Supabase, Resend, Calendly, and communications or AI providers. Temporary outages, maintenance, or provider changes can occur. We will use reasonable efforts to restore material service interruptions but cannot guarantee uninterrupted availability of third-party systems.
12. Liability
Liability is governed by Austrian law. To the extent legally permitted in a business-to-business relationship, liability for slight negligence is excluded except where an essential contractual obligation is affected; in that case liability is limited to the typical, foreseeable damage. No limitation applies to intent, gross negligence, personal injury, or liability that cannot legally be excluded.
13. Data protection
Personal data is processed as described in the Privacy Policy. Payment card data is entered directly with Stripe and is not stored on GrowthEko servers.
14. Changes
The Terms applicable when an order is placed govern that order. For an ongoing Membership, we may update these Terms for objectively justified legal, security, or service reasons. Material changes will be communicated in advance by email. Price increases apply only to future billing periods after reasonable advance notice, and you may cancel before they take effect.
15. Austrian law and venue
Austrian law applies, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods. For disputes between entrepreneurs, the court with subject-matter jurisdiction at the operator's business location is agreed as the venue to the extent legally permitted.
16. Final provisions
If any provision is invalid or unenforceable, the remaining provisions remain effective. Changes and side agreements should be documented in text form. No waiver is created by a delay in enforcing a right.
